CONTRACT

1. GENERAL

Borneo Film Equipment (BFE) reserves the right to rent or not to any individual or company based on the

discernment of the trustworthiness of each renter.

2. Rate Calculation

50% discount is automatically applied for weekly rentals.

Pickup day after 1pm (the day before rental day) will not be charged.

Subsequently, return day (the day after rental day) before 11am will not be charged too.

Collection in the morning and returning at night is considered one day.

E.g. collection at 10am, and returning at 10pm on the same day is considered one day.Our studio standard operation time: weekday 8:30am - 3:30pm.

Off operation time pickup and return may incur a fee.

3. Payment & Booking of Dates

Full rental fee upfront is necessary to lock down dates and gears.
Security Fee might required for large order.

4. Quotation & Invoice

Quotation and invoice is issued before rental service and upon confirmation.

5. Delivery, Collection & Services

It is your responsibility to collect the hire gear from us. We may be able to deliver for a fee. You are responsible for the acts or omissions of your agents, employees, sub-contractors or any other person who acts on your behalf under this agreement. You are also responsible for the acts or omissions of our staff and agents where they are acting under your direction, instructions, guidance or advice.

You will provide sufficient access to and from any relevant site and provide sufficient unloading space, facilities, equipment and access to the power supplies for our employees, subcontractors and /or agents to allow them to carry out the services. You warrant that the site where the services are to be performed is, where necessary, safe, cleared and prepared before the services are due to commence.

If any services are delayed, postponed and/or are cancelled due to the your failing to comply with your obligations, then you will be liable to pay our additional standard charges from time to time for such delay, postponement and/or cancellation.

6. DAMAGED & LOST

Upon taking possession of the rented film equipment, the undersigned acknowledges having thoroughly

inspected the gear and confirms its satisfactory working condition, thereby giving explicit consent. In the event of

any damage or need for repair, the renter agrees to bear all associated costs.

Renter needs to pay for full fixing or replacement cost, plus logistic fee incase of any damaged or loss.

Order more than RM5000, renter may need to pay for security fee, fees calculated may differ depends on order.

It is the renter’s responsibility to take good care of any rental gears and supplies. You agree that the Hire Goods

must by returned by you in good working order and condition (fair wear and tear excepted) and in a clean condition

(every day grime excepted) together with all insurance policies, licenses, registration an d other documents relating

to the Hire Goods.

Furthermore, Borneo Film Equipment (BFE) reserves the right to charge the renter for damaged or lost gear

immediately upon confirmation of the damage or loss, without the obligation to conduct independent market

research or price matching, provided the value is repaid on a direct 1-to-1 replacement or valuation basis. BFE is not

responsible for, nor bound by, any delays caused by the renter's third-party insurance claims. The renter's primary

financial obligation to settle repair or replacement costs remains absolute and unaffected by the progress or delays

of any insurance payouts.The undersigned acknowledges full awareness of this contract and confirms agreement with every single particular

and condition contained herein, with specific acknowledgment of the terms regarding gear damage, loss, and

financial responsibility.

7. REFUND POLICY

You have the right to cancel any order and be entitled to a full refund on rental charges, providing notice of at least

14x days (2 weeks) from an order date are given and possibly earlier, subject the discretion of management. Please

advise us by email, call or Whatsapp in the event of a required cancellation.

Confirmed bookings reserve specific equipment exclusively for the renter, preventing other potential rentals.

Cancellations made less than 48 hours prior to the scheduled pickup time will forfeit any booking deposits paid and

will incur a cancellation fee equal to 50% of the total order value. Same-day cancellations or failure to show up for a

pickup will result in a 100% charge of the total rental fee.

8. LATE RETURNS

Equipment must be returned on the exact date and time specified in the rental agreement. Any unauthorized

extension or failure to return the gear on time will incur a late fee equivalent to 100% of the daily rental rate for each

calendar day (or part thereof) that the equipment remains unreturned. Continued failure to return the equipment

past the agreed return date may, at BFE’s discretion, be treated as unlawful conversion or theft, and reported to the

relevant authorities.

9. Permitted Use, Geographic Restrictions, & Environmental Hazards

The rental gear must be operated strictly by qualified professionals in a proper, safe, and lawful manner. The renter

shall not sub-rent, loan, assign, or transfer the equipment to any third party. Equipment must remain within approved

geographical limits (Malaysia) unless explicit written consent is provided by BFE. Furthermore, the renter assumes

total liability for protecting the equipment from environmental hazards, including but not limited to tropical rain,

moisture, high humidity, salt water, river, dust, and sand. Damage resulting from environmental exposure or

improper handling is entirely the renter's financial responsibility.

10. Electrical & Power Supply Risk

The renter is solely responsible for ensuring safe, stable, and adequate power sources for all electronic equipment,

lighting, and accessories. BFE shall not be held liable for any equipment failure, short circuits, or internal damage

caused by faulty generators, unstable local power grids, improper voltage, or lack of proper surge protection. Any

damage resulting from power irregularities will be billed directly to the renter under the standard repair or

replacement terms.

11. Data Loss & Media Disclaimer

BFE accepts zero responsibility or liability for any loss, corruption, formatting errors, or damage to data, video

footage, audio recordings, or files captured on rental cameras, monitors, or storage media (SD cards, CFexpress,

SSDs, etc.). It is the sole responsibility of the renter to offload, verify, and back up all data prior to returning the

equipment. All storage media returned to BFE may be formatted or wiped without notice.12. Operational Loss & Delayed Payment for Damage or Loss

In the event that gear is damaged or lost and the renter delays full payment for the repair, replacement, or

settlement costs, Borneo Film Equipment (BFE) reserves the right to charge an operational loss fee. This fee will be

calculated continuously at a discounted daily rental rate for the affected items, as if the gear were still actively on

hire, and will accrue daily from the date of the incident until the damage or loss is fully paid and settled in full.

Upon taking possession of the rented film equipment, the undersigned acknowledges having thoroughly inspected

the gear and confirms its satisfactory working condition, thereby giving explicit consent. In the event of any damage

or need for repair, the renter agrees to bear all associated costs.

Furthermore, the undersigned acknowledges full awareness of said contract and confirms agreement with every

single particular and condition contained herein, with specific acknowledgment of the terms regarding gear

damage and financial responsibility. The renter further acknowledges that it is their sole responsibility to seek

out, review, and read these rental terms and conditions—whether publicly available on BFE's website, brochures, or

otherwise accessible. Borneo Film Equipment (BFE) is under no legal obligation to individually or manually furnish

a copy of these terms for them to be fully binding, as these conditions represent standard, logical practices

governing commercial equipment rentals.

This rental is strictly subject to Borneo Film Equipment's Standard Terms and Conditions, viewable

at www.borneofilmequipment.com/terms>. By proceeding with payment or taking possession of the gear, the renter

explicitly agrees to all terms contained therein.
